Interpretation

The words of which the initial letter is capitalised have meanings defined under the following conditions.

The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

Company (referred to as either " The Company", "We", "Us" or "Our" in this Agreement) refers to Baby Steps Sleep Training.

​

Country refers to: United Kingdom & Worldwide

​

Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

​

Service refers to the Website.

​

Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You (also referred to as the “Parent”) and the Company regarding the use of the Service.

Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.

​

Website refers to Baby Steps Sleep Training, accessible from www.babystepssleeptraining.com

​

You (also referred to as the “Parent”) means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgement

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. The acceptance of a Consultation Package, either online or in Your home will be deemed as acceptance of these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

Baby Steps Sleep Training follows the evidence based research and internationally recognised sleep practices.

​

1. You are required to pay the invoice of Your chosen consultation package prior to the assessment. You agree that Your sleep assessment will not be written until We receive full payment. International bookings will incur a £5 booking fee as such payments are processed via PayPal.

​

2. You agree not to share the personalised written sleep assessment with a Third Party and understand that it is individual to only You and Your own child’s needs and should therefore not be used by anyone else.

​

3. It is agreed that all Parents shall follow safe sleeping practices at all times and in line with SIDS recommendations in relation to their  child's sleep. It is advices You refer to the AAP’s website for safe sleep guidelines.

​

4. You understand that it is solely Your responsibility to ensure Your child’s safety and in the event that You fail to notify Us of any unsafe

sleep practices, You fully agree that We cannot be held liable in any way.

​

5. You agree that the role of Baby Steps Sleep Training is to work closely with Parents and their children to help develop better sleep     habits by creating personalised sleep plans and offering support and guidance  as needed to help You implement them. Your sleep training 

success is  particularly dependent on Your own consistency in  following and implementing Our recommendations in the sleep plan. We therefore offer no guarantees that We can resolve all sleep problems.

6. Our evidence based methods are proven to work more efficiently when Parents are fully committed to making a change. By choosing to start the sleep training process with Us you are entering into an agreement and will be expected to communicate with Us effectively, to be honest and upfront in Your expectations and to work closely alongside Us throughout, in order to achieve faster and better results. We will  do whatever it takes to meet Your needs.

7. In a small amount of cases a certain method might not bring about the expected results, in which case We are happy to review the sleep plan and try a different approach/sleep training method You feel comfortable with in order to help You  achieve your goals. If We still do  not see any improvement despite of Your consistent approach, You may consider speaking with your child’s GP to rule out any underlying health issues. We do not recommend that You implement new methods prior  to consulting with Us first as this may delay the progress.

8. You acknowledge that sleep training takes dedication, persistence, patience and most of all consistency. It is important that You ensure no disruptions in the period in which You will be expected to implement the sleep plan and Our recommendations in it. We ask Parents to read the sleep plans carefully and to make sure You understand them.

​

9. Your 7 day follow-on support included with Your chosen package will start no later than on the next day after You are sent the written sleep plan via email. Should Your child fall ill on the day of starting the sleep training process, You are required to notify Us immediately in order for Us to postpone the sleep training to a later date. This must commence within 2 weeks from the original date booked.

​

10. You may contact Us from Monday – Saturday between 8.30 – 5.30pm (Sundays are usually non-working days but We may be able to accommodate requests for support for an additional fee) during Your unlimited 7 day email support period which is included in your consultation package. Should You choose not to take advantage of this included support, a strict no refund policy applies. If You don’t make contact with Us during Your 7 days support period, We shall assume that things are going according to plan and You require no further assistance from Us. Your package also includes a 15 minute phone consultation and another follow up catch-up phone call. Any additional email and phone support can be purchased separately. Please refer to Our website for pricing. We aim to respond to Your emails within 24 hours and depending on the urgency We may respond much sooner.

11. Prior to starting sleep training, You should ensure that Your child is healthy and You agree to check with your GP if you suspect Your

child may have any medical conditions and whether these could interfere with safe sleep training.

​

12. Baby Steps Sleep Training does not offer medical advice neither it makes medical diagnoses and any sleep training advice given by Us to You is not intended to replace a consultation with a qualified healthcare professional. We are however able to offer support in identifying sleep disorders and suggest when medical intervention may be necessary. Any concerns regarding Your child’s medical health should be discussed with the child’s GP or Paediatrician.

13. It’s important that You disclose any medical condition or health concerns Your child may have in the early consultation stages so that We can analyse these before putting together a personalised sleep plan for Your child.

​

14. You accept and acknowledge that your child may protest during sleep training and this is usually because of frustration of not getting as much help with falling asleep and learning to fall asleep independently. We therefore cannot guarantee no tears throughout the process of changing Your child’s sleep habits. However, with Our methods You will be able to offer Your child some reassurance and comfort.

15. You acknowledge that following Our initial phone/home/online consultation, it may take up to 48 hours for You to receive the written personalised sleep plan via email.

​

Cancellations and Refund Policy

16. All consultations are scheduled a few days in advance and we may have turned down other Parents to accommodate You. Our cancellation fees are as follows: 

​

Before 48 hours – We will refund 90% of all consultation fees, minus 10% non refundable admin fee.

48 hours and less – No refund

​

Please note:

Once Our work with You has commenced, any failure on Your part to follow Our recommendations in the sleep plan by refusing to implement them, including not using the 7 day follow-on support will not result in a refund being paid.

 

Rescheduling policy due to illness or other emergency

17. Due to unexpected personal circumstances, be it illness or another emergency We may need to cancel Your consultation at a last minute. We will endeavour to provide You with a next alternative available date to reschedule Your consultation at a time most convenient for You.

 

18. It is not be advisable to go through the sleep training process if Your child is very ill in which case We will try to do our best to accommodate You and Your child by offering to reschedule Your appointment to another more suitable date (to start within 2 weeks of the initial booking date). Should this be the case, You must contact Us in writing as soon as possible!

Parking charges for in- home consultations

19. In the event that paid parking charges apply at Your home address and visitor’s permits are not available for use by Baby Steps Sleep Training, You agree to cover such expenses and they added to your original invoice. This will be established prior to the consultation taking place.

​

20. You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

​

Confidentiality

21. Baby Steps Sleep Training takes confidentiality very seriously and requests that all information shared between Us and the Parents is to remain confidential. As part of this element, You also agree to respect Our privacy by not discussing on social media or publicly any exchanged conversations be it chats, emails, phone consultations or to disclose to a third party any details and content shared between You and Us. The consequence of a breech will result in immediate termination of Our contractual agreement.

Links to Other Websites

22. Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company.

​

23. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.

24. We strongly advise You to read the terms and conditions and privacy policies of any third-party websites or services that You visit.

​

Termination

25. We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

26. To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms). 

 

To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect  to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results.

Without limiting the foregoing, neither the Company nor any of the company's provider makes any representation or warranty of any kind, express or implied: as to the information, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms or malware.

Disputes Resolution

27. If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

Changes to These Terms and Conditions

28. We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion. It is recommended You take notice of any changes by occasionally visiting these pages.

29. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
